HIKING AND ADVENTURES
1. Purpose
These Terms and Conditions govern the use of Hiking and Adventures’ digital channels for the inquiry, reservation, and purchase of tourism services.
By using any of these digital channels, the user acknowledges and agrees to be bound by these Terms and Conditions.
2. Digital Channels
The following are considered the Company’s digital channels:
- Website.
- WhatsApp.
- Facebook.
- Instagram.
- Email.
- Online booking platforms.
3. Reservations
A reservation shall be considered confirmed only when:
- The customer has accurately completed all required information.
- The corresponding payment has been made.
- The Company has confirmed the availability of the requested service.
4. Payment Policy
To confirm any reservation, the customer must pay 50% of the total price of the contracted service as a deposit.
The remaining balance must be paid before the start of the service unless otherwise agreed in writing by both parties.
The Company reserves the right to automatically cancel a reservation if the required payment is not received within the established deadline.
5. Refund Policy
If a customer voluntarily requests the cancellation of a reservation and a refund is applicable, an administrative fee equal to 30% of the refundable amount shall be deducted. This fee covers administrative, banking, operational, and management costs already incurred.
Refunds will not be granted in the following cases:
- The customer fails to appear for the service (No Show).
- The cancellation is made outside the deadlines established by the Company.
- The service has already commenced.
If the cancellation is solely attributable to Hiking and Adventures and no equivalent alternative acceptable to the customer can be provided, the Company shall issue a refund in accordance with the applicable consumer protection laws.
6. Customer Obligations
The customer represents and warrants that:
- The information provided is true and accurate.
- They will comply with all safety instructions.
- They will disclose any relevant medical condition that could affect their participation.
- They will comply with the established schedules and meeting times.
7. Liability
Hiking and Adventures shall not be liable for delays or cancellations resulting from:
- Natural disasters.
- Social conflicts or civil unrest.
- Government restrictions.
- Closure of tourist attractions.
- Force majeure or unforeseen circumstances beyond the Company’s reasonable control.
In such cases, the Company will make reasonable efforts to reschedule the service whenever possible.
8. Personal Data Protection
The processing of personal information shall be carried out in accordance with the Company’s Personal Data Protection Policy.
9. Intellectual Property
All content published through the Company’s digital channels, including but not limited to text, images, logos, videos, and trademarks, is the exclusive property of Hiking and Adventures and may not be reproduced, distributed, modified, or used without prior written authorization.
10. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Peru.
Any dispute arising from or related to these Terms and Conditions shall be resolved in accordance with the applicable laws and regulations of Peru.
